    POINT OF ORDER!

    By Robert Stern

It’s no secret that this current desperate board majority seems determined to ram through some MC deal at the April 24th Board meeting. But is it 100%? All 7 members?

During the comment section at the April 24th meeting several homeowners need to comment that “you (I was) (are )unable to evaluate this MC contract/lease that has not been presented in its final form for vetting prior to this meeting and that my comments I am now making are to be specifically included in the minutes.

And it is my belief that this MC Lease matter ought to be tabled to a future meeting when all homeowners will have had the opportunity to review and comment on what the board is going to vote on.”

It is long standing practice at SCA that supporting documentation is provided in the board book for homeowners to evaluate. This board doesn’t seem to want to follow the long standing practice when it comes to the matter of this MC lease.

The GM stated at the Finance Committee that homeowners would not be given an opportunity to review prior to a board vote. That violates the long standing order of process of SCA allowing homeowners to make informed comments and accordingly this matter ought to be tabled until a future meeting as it cannot be lawfully decided on April 24.

Representatives of the Finance Committee past and present ought to speak up as they effectively did in March.

This board does not respect the community it serves. It is on its own mission. Ironically it “caters” to its own needs not the community’s. Honestly it is disgraceful and an embarrassment.

Do we have one honest functional board member that will speak up under Robert’s Rules of Order which are incorporated into our process. When the matter sticks on the April 24th agenda and is recognized the functional board member will interrupt( as is permitted) and declare, ” Point of Order”.

The Chair is required to immediately recognize the board member and say ” State your point of Order”

The Board member states that “the MC contract to be approved today was not presented in the Board Book for homeowner review and that the GM improperly stated at the Finance Committee that homeowners would not be given an opportunity to review and comment prior to a board vote. That violates the long standing order of process of SCA allowing homeowners to make informed comments after reviewing detail and accordingly this matter ought to be tabled until a future meeting as it cannot be lawfully decided today.”

Then the chair must rule. There is no debate allowed. There is no discussion allowed. The Chair must rule. That’s Robert’s Rules of Order.

If the Chair denies the point of order, the chair will have to state why and by doing so opens the matter of different options. But I am not going to address that avenue. There is a better avenue. The homeowners creating a legal record of their objections is the way to go.

The good news is if enough of you homeowners( probably only takes one but more is better) go on the record during the Comment section at the beginning and the board proceeds ignoring you and your well established SCA rights, then the new board probably can simply put it back on a May agenda and put the MC lease in the May board book, then at meeting put it to a vote in due process and if it so chooses, defeat it. What happens after that is entirely up to the board.

It seems that this current board(until May 1) with GM help wants to steamroll and abuse process. That’s too bad. We deserve better governance and better management.

Candidates 1.3.5.7 if you still have a ballot to cast.

    Until next time… Robert
