Yesterday was the last day to introduce a bill during Nevada’s 83rd Legislative session.
Not surprising, SB 433 was introduced.
It is an almost exact copy of SB 417(2013) introduced during the last session by
CAI (HOA industry) by Adam Clarkson.
You will recall SB 417 sought to allow an executive board, a director, a manager, and/or an employee of any vendor
the right to bring a civil action for what is described as “bullying”..
The chilling effect of this on HOAs across Nevada should this bill pass can not be underestimated.
Nevada already has bullying laws in place.
Last session I testified “In my eight years serving on both small and large HOA boards and years advocating for HOA legislative change, this is likely the most dangerous bill I have seen.
” My position has not changed. The power of a board to initiate litigation has always been strictly limited for good reasons most notably 1) litigation costs are paid by owners and 2) rogue Orwellian boards could seek to target, without accountability, good faith owner opposition.
We defeated this SB 417 last session. It appears we will need to do it again. You will find the link to the bill here https://www.leg.state.nv.us/App/NELIS/REL//83rd2025/ Bill/12781/Overview
I have attached SB 417 as enrolled last session along with my testimony strongly opposing the bill. I believe many of you also submitted testimony opposing SB 417. I ask you dust it off and be prepared to submit comments once the bill is scheduled for a hearing. I also ask you express an opinion on the bill’s legislative page.
Please get back to me to coordinate how we may make HOA owners aware of the attack. Please forward this email to everyone you know living in HOAs.
Regards,
Mike Kosor
