                                                      WORD ON THE STREET

    By Robert Sterin

Again having attended the Men’s Breakfast and listening to candidates and then others after the meeting I can report the following:

    1. Every single candidate in attendance commented on the restaurant deal by agreeing if it isn’t in the contract then don’t expect the Fairy God Mother to grant wishes.

    The three key points were

    a. there is no definition of a restaurant as to what would be required

    b. there is no timetable therefore we may never get a restaurant therefore putting SCA in non compliance for those who believe the governing documents require a restaurant and

    c. there are no termination provisions. PERIOD. There was openness by the candidates to wait and see what the new draft included but without a written document provided in the March Board Book ,in my view, this issue should never make it to the agenda.

    2. Also since the Restaurant committee was officially terminated and the Finance Committee’s objections to the current lease proposal haven’t even yet been presented( Finance Committee doing so tomorrow) let alone addressed then how is it possible to rush to judgment and create a board agenda item? This makes no sense.

The President has the authority to approve the agenda after proposed by the Secretary. So who is in charge here? Which board member has now been assigned to negotiate with MC?

    3. All candidates were critical of the current board ‘s secret meetings in violation of EVERYTHING and pledged to end the practice. That doesn’t give President Donna Griffith and Secretary Pam Williams free license to continue to violate the law.

And other current board members should walk out of any meeting or refuse to go if not properly noticed with an agenda. And without a properly noticed meeting nothing regarding this catering/ non restaurant lease can be decided.

And only board members and CAMs and GM are authorized to attend a “workshop” for agenda setting. This board needs to act in good faith for once and other than needed staff exclude other homeowners. It is rumored that President Donna Griffith plans to openly violate her responsibilities in this regard for this Thursday’s agenda setting discussions by inviting an unofficial “board member” to participate. Really?

    4. And based on the economics of the deal, SCA is being taken to the cleaners. If this deal is to go through, MC needs to put some skin in the game called CASH! MC gets cost savings of nearly $1.8 million, 4 times the facility space of their current operations and we pay their utilities and trash removal 100% for $1 rent.

No termination provisions. Everyone talks about us sharing monies at 3% after $1.5 million in sales. We should get a minimum non refundable $50,000 annual advance against this calculation since all the believers in the Fairy God Mother are promising us this will happen. And a penalty to double it to $100,000 annually if SCA doesn’t get its full service restaurant as defined. Best bet is to pass this negotiation over to Jim Mayfield and crew after May 1.

May 1st cannot come soon enough. 43 days to go!

    Until next time…Robert
